1. About FortuneSoul
FortuneSoul is operated by Fortunesoul Import and Export Limited, incorporated in Hong Kong. By using our website or placing an order you agree to these Terms and Conditions and to our Privacy Policy.
Related Policies. These Terms incorporate our Refund & Return Policy, Privacy Policy, and Personal Information Collection Statement. If there is any inconsistency, these Terms govern except for personal data matters, where the Privacy Policy and PICS govern.
2. Using The Website
Use the site only for lawful purposes. Do not attempt to interfere with the site, collect data without consent, or use any automated tools that may impair service. We may suspend or block access where we suspect misuse.
3. Information Accuracy
We work to keep information current and accurate, but content may contain errors or omissions. We may correct or update information at any time without prior notice.
4. Intellectual Property
All content, including text, graphics, logos, images, audio, video, and the site design, belongs to FortuneSoul or our content partners. You may not copy, reproduce, distribute, adapt, or use our content without written consent.
5. Products And Availability
Images and descriptions are for guidance. Shades, finishes, and packaging can vary. All products are subject to availability. We may limit quantities or refuse any order where we suspect improper use such as reselling.
6. Orders And Acceptance
Placing an order is an offer to buy. We accept by confirming shipment. If we cannot accept your order, we will cancel or refund the affected items. We recognise electronic records and contracts as valid in Hong Kong.

7. Prices, Currency, Taxes And Duties
Prices and currency. Prices appear in the charge currency shown at checkout. If your payment card uses a different currency, your bank sets the exchange rate and may charge fees.
Taxes and duties. International deliveries may be subject to import duties, value added tax, and clearance fees assessed by the destination authority. These charges are payable by the recipient. FortuneSoul does not collect or set these charges and cannot declare a lower value or mark shipments as gifts. We declare the accurate value and contents of all shipments.
Customs processing. Customs inspections may delay delivery and are outside our control. Local authorities or carriers may request identification numbers or documents from the recipient to complete clearance.
Unpaid charges or refusal. If a shipment is held or returned due to unpaid charges, incorrect information, or refusal to accept delivery, we can reship upon request once we receive the additional shipping fee. Original shipping charges are not refundable.
8. Payment Policy
Payment methods appear at checkout. Payments are processed by trusted providers with secure encryption. We do not store full card numbers. Your bank may require additional verification such as one time passwords or 3D Secure. We may decline or refund an order we cannot verify.
Discount codes, gift cards, vouchers, and store credit must be applied before payment is completed. Unless stated otherwise, offers cannot be combined and are not applied after checkout.
If there is a payment or billing issue, contact us first so we can help. We may investigate chargebacks that appear abusive.
9. Billing Policy
Your order email is your receipt. If you need a formal invoice, reply with your billing details. Keep your billing name, address, email, and payment details accurate. If we find a clear billing error we will correct it. For overcharges we will refund the difference. For undercharges we may charge the difference after notifying you. If a payment fails or remains pending we may place the order on hold or cancel it.
10. Preorders And Backorders
Definition. A preorder or backorder is an advance purchase for an item that is not yet in stock. Availability dates are estimates and may change.
Payment. Payment is captured at checkout for all preorder and backorder items.
Estimated ship window. We provide an estimated ship date or window as guidance. This is not a guarantee. Supplier schedules, carrier rules for fragrances, and customs processes can affect timing.
Combined carts. If your order includes in stock items and preorder items, the order ships together when all items are ready. You may request a split shipment for an additional shipping fee.
Allocation and limits. Quantities are limited and are fulfilled in the order paid. If we receive fewer units than expected, we may cancel the affected item and issue a refund or offer store credit or an alternative.
Product changes. Packaging or minor presentation details may differ from images shown. Samples and discovery items may vary in concentration or format.
Price changes and promotions. The price at checkout is final for your preorder. Later price changes or promotions do not apply retroactively unless we state otherwise.
Address changes. You may request an address update before the order is locked for fulfilment. Once dispatched we cannot change the address.
Cancellations and significant delays. Preorders and backorders are not cancellable after payment except where an item becomes unavailable. If there is a significant delay, contact us and we will offer options which may include an alternative, store credit, or a refund for the affected item.
Returns. The same Returns Policy applies. We do not accept returns for change of mind or opened items. We will assist with defective or incorrect items according to our Returns Policy.
Customs and duties. Import duties, value added tax, and clearance fees are assessed by the destination authority and are payable by the recipient. Customs inspections may delay delivery and are outside our control.
11. Shipping Policy
We aim to process and dispatch orders promptly. Delivery times vary by destination and carrier and are estimates only. Tracking is emailed when your parcel is dispatched. Some fragrance items may be restricted on certain routes due to carrier rules. If a parcel arrives damaged or appears tampered, photograph the condition and contact us within 48 hours so we can assist. If a delivery is refused or unclaimed and returns to us, we can reship after we receive the additional shipping fee.

12. Risk And Title
Title and risk in the goods pass upon delivery to the address you provide.
13. Refunds And Returns
We handle returns only for defective or incorrect items in line with our Refund & Return Policy. We do not accept returns and do not offer refunds for change of mind or opened items. Time frames, required evidence, and remedies are set out in the Refund & Return Policy. Original shipping fees are not refundable unless required by law or we state otherwise.
14. Samples, Discovery Sets, And Gifts
Samples and discovery items are intended for evaluation and may differ from the final product in concentration or packaging. Gifts with purchase are subject to availability and may be substituted.
15. Reviews And User Submissions
If you submit reviews, comments, or other content, you grant FortuneSoul a non exclusive, royalty free licence to use, reproduce, adapt, and display that content on our site and channels. You confirm you own or control the rights to what you submit and that it is accurate and lawful.
16. Prohibited Activities
You must not violate any applicable laws, infringe the rights of others, reverse engineer or test the vulnerability of the site, or use the site to send unsolicited commercial messages to users.
17. Legal Guarantees And Limits
Nothing in these Terms reduces non excludable rights under Hong Kong law, including implied conditions as to description, merchantable quality, and fitness for purpose in consumer sales under the Sale of Goods Ordinance. Any limits on liability apply only so far as permitted and must be reasonable under the Control of Exemption Clauses Ordinance.
18. Fair Trading
We do not engage in misleading or aggressive practices. If a mistake occurs we correct it and refund where appropriate. The Trade Descriptions Ordinance prohibits false trade descriptions and specified unfair trade practices.
19. Communication And Marketing
We may contact you about your orders and service notices. For marketing messages we follow Hong Kong rules for direct marketing and electronic messages, including clear sender identification and an unsubscribe facility. Unsubscribe requests are honoured within the statutory period.
20. Third Party Links
We are not responsible for the content, security, or privacy practices of linked third party sites.
21. Changes To These Terms
We may update these Terms. Changes take effect when posted on the website. Your continued use of the website after changes are posted means you accept the updated Terms.
22. Severability
If any part of these Terms is found unlawful or unenforceable, the remaining parts continue in effect.
23. Entire Agreement
These Terms together with the policies referenced above form the entire agreement between you and FortuneSoul for purchases made on our site.
24. Governing Law And Jurisdiction
These Terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong have exclusive jurisdiction.
